As the October 31 by-election for the Lagos East senatorial district draws nearer, APC Candidate, Mr Tokunbo Abiru, may be disqualified for alleged double registration which is contrary to electoral law 2010 as amended.
InsideMainland’s investigation revealed that Mr Abiru In 2014 registered in Eti-Osa local government of Lagos state which makes him ineligible because it falls within the Lagos Central senatorial district as opposed to the Lagos east which he’s contesting.
Lagos east senatorial district is made up of five local governments namely; Epe, Ibeju-Lekki, Ikorodu, Kosofe and Somolu.
Electoral law 2010 as amended in section 24 (1) (a) & (e) provides that; Any person who makes a false statement in any application for registration as a voter knowing it to be false and (e) says, “by himself or any other person procures the registration of himself or any other person on a voter register for a State, knowing that he or that person is not entitled to be registered on that voters register or is already registered on it or on another voter register commits an offence and is liable on a conviction to a fine not exceeding N100,000,00 or imprisonment not exceeding one year or both.”
In the suit filled in the Federal High Court of Nigeria In the Lagos Judicial Division holden at Lagos, the People’s Democratic Party (PDP) and its candidate, Babatunde Gbadamosi are asking for the disqualification of Abiru on at least two counts.
First, Mr Abiru has two Permanent Voters cards, (PVC number: 90F5BO5EEB295604194, and PVC number: 90F5AFEA90418213518). Second, Mr Abiru is not registered to vote in the East Senatorial District.
PDP, according to the Media Director of Gbadamosi Campaign organisation, Dr Adetokunbo Pearse said; “Our evidence for the first case against Mr Abiru can be verified from the Voters Register as it exists on INEC server. For the second case against Abiru, we refer to his letter of 14th August 2020 to INEC, requesting a transfer of his address from Road A2 HSE Ago, Carlton Gate Estate, off Chevron Drive, Lekki Lagos, to 38 Oriwu Road, Ita Elewa, Ikorodu Lagos. Mr Abiru’s request was not granted, because as INEC explained to him, ‘ Continuous Voter Registration Exercise is presently suspended’ Clearly, therefore, based on case number 1, Mr Abiru is guilty of identity fraud.
“With two PVC’s, it is reasonable to assume that Mr Abiru is one of those people who vote multiple times on election day. Based on case number 2, it is clear that Mr Abiru cannot vote in the October 31st Lagos East Senatorial Election. “According to the constitution, a citizen who cannot vote cannot be voted for. The case against Mr Abiru is watertight.”
The National Leader of the APC, Mr Bola Tinubu may not have considered the obstacle the double registration and ineligibility issues raised by the PDP and its candidate before giving the ticket to Mr Abiru who was a managing director in Polaris Bank.
Reacting to the issue, APC spokesman, Mr. Seye Oladejo said there was nothing to worry about the alleged double registration and the fact that Mr. Abiru had earlier registered in Eti-Osa which makes him ineligible.
It will be recalled that the Lagos East senatorial district became vacant when Senator Adebayo Osinowo who represented the district died in June 2020.
